1:  DEFINITIONS

For the purposes of this Privacy Policy:

  1. “Control”,shall mean the power to direct or cause the direction of management and policies of KUTTUS, either directly or indirectly, whether through ownership, or through voting securities, or the power to appoint or remove a majority of the members of, or the power over a majority of the voting rights cast in meetings of, the board of directors or equivalent governing body of KUTTUS, whether by operation of law, or by contract or otherwise.

 

  1. “Device”,  shall mean a hardware interface that facilitates use of Service(s) and access to and/ or streaming of Content(s) via internet and includes a personal computer (desktop/ laptop), mobile device, portable media player, TV, chrome-cast, Blu-ray disk player, set top boxes (any smart device connected to television or any other audio-visual device including internet supported set-top boxes), gaming systems/ consoles, pre-embed/ pre-load platform/ OTA push on third party manufactured device (mobile phones, smart devices) or any other hardware devices in commercial use presently or developed in future that are capable of offering access to KUTTUS Platform(s) and meets the compatibility and minimum system requirements that KUTTUS requires from time to time.

 

  1. “Data Controller”, for the purposes of the GDPR (General Data Protection Regulation), refers to the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data.

 

 

  1. “Do Not Track (DNT)” is a concept that has been promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission (FTC), for the Internet industry to develop and implement a mechanism for allowing internet users to control the tracking of their online activities across websites.

 

  1. “KUTTUS Platform” means and refer to MAITRI AV COMBINES,  representing through its Proprietor and having address at 2/47, Sree Colony, Kolkata – 700092, as the case may be.

 

  1. "Personal Data/Information" is any information that relates to an identified or identifiable individual. For the purposes of GDPR, Personal Data means any information relating to You such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity. For the purposes of the CCPA, Personal Data means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.

Sale”, means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Consumer's personal information to another business or a third party for monetary or other valuable consideration.

 

 

  1. “Subscriber”,  means a natural or legal person who has purchased a Subscription to KUTTUS Platform(s) and attend the age of majority.

 

  1. “Subscription”,  shall mean the package of Service provided to a Subscriber which can be availed either directly from KUTTUS or its Authorised Partners against payment of a fee, more particularly detailed under Subscription and Payments.

 

  1. “Service Provider” means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

 

  1. “Subscriber”,  means a natural or legal person who has purchased a Subscription to KUTTUS Platform(s) and attend the age of majority.

 

  1. “Service”, shall mean video on demand service and other ancillary services provided by KUTTUS through KUTTUS platform(s) to users and subscribers for accessing and watching/ streaming content(s), features and functionalities for Subscribers to post user materials among others.

 

  1. “Tenure or Billing Cycle”, means the period of subscription under the plan

 

  1. “Terms”, of use shall mean that this agreement is supposed to be read in conjunction and together with the Privacy Policy as may be updated from time to time (Refer Changes) in relation to a User’s and/or a Subscriber’s access to and use of Service(s).

 

  1. “Users”, means a natural or legal person who accesses KUTTUS Platform (s) whether or not availing Service(s).

 

  1. "Usage Data" refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

 

  1. "Website" refers to kuttus.co.in, accessible from https://kuttus.co.in

 

  1. "You" means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

 

 

2: COLLECTION AND USE OF PERSONAL DATA AND  INFORMATION

(A)   Information given by you to communicate

We may use information about you to communicate with you, such as:

  1. Send updates about new contents uploaded on KUTTUS Platforms;
  2. Details about new features of the KUTTUS Platforms;
  3. To communicate with you, either directly or through one of our authorised Partners, for marketing and promotional announcements;
  4. Consumer Surveys;
  5. Confirmation of your membership Plan, including expiry and renewal thereof;
  6. Deliver services you request, process transactions and send you related information, including assistance with operational requests like password change request etc.

     

These communications may be through numerous procedures including but not limited to email, push notifications, phone calls, text messages, WhatsApp messages.

Where we refer to 'Personal Information' we mean any information related to a particular individual who we identify (whether directly or indirectly) a particular individual or natural person. This includes direct identifiers such as your name, postal address, email address, and mobile number, and also includes all other information which is linked to that information such as your location. Where we refer to “ID” we mean a list of numbers and/or letters (also known as a numeric or alphanumeric string) which we or our service providers may generate and which is used as a means to give you a unique customer or user identifier – it cannot directly identify personally but it may be able to do so where your Personal Information is associated with it.

We may ask for and you may choose to provide the below information, which may include Personal Information, when you use or register for the KUTTUS platform or use any of the features or services available on the Platform (such as game play) or contact us directly: Name, Email Address, Phone number, Age or date of birth, Gender, Password, Location, pin code, area code, and occupation as provided by you, Payment and other information pertaining to your transactions on the KUTTUS Platform, any service requests, Search terms, language preferences, content preferences, account settings, user-generated content including comments, photos or videos which you choose to upload or broadcast on the Platform, game play data during game play events on our Platform, or other profile information, such as social media account information and profile image, information you share when you participate in marketing promotions, prize draws or competitions, any other information that you may otherwise choose to provide us.

 

In some cases, where you access our Platform service available via mobile devices, Smart TVs or Internet connected TVs or Internet connected devices (“streaming devices”) your streaming device may store some of your Personal Information in their memory. These streaming devices are operated by third parties and these third parties will have their own privacy notices or other policies regarding the handling of Personal Information that they independently collect from such streaming devices. You should carefully read the privacy notice and policies of these streaming devices. We are not responsible for the privacy practices of these third parties, and the information practices of these third parties are not covered by this Privacy Notice.

 

(C)    Information we collect automatically

We and certain third parties on our behalf may collect information about you and your use of our Platform or our advertising as well as information regarding your computer or other streaming device used to access our service. The information may be collected using tracking technologies such as cookies, Flash cookies, pixels, tags, software development kits and  application program interfaces. This information may include the platform or website that you just visited (whether this platform is on KUTTUS Platform or not), which platform or website you next visit. Advertisement identifiers such as IDFA, GAID etc and data related to your interaction with the advertisement that are served on the KUTTUS Platform;

 

We capture information related to the performance of the mobile application and the Platform, such as crash logs, build analytics and other performance statistics generated when you use the Platform;

 

(D)   Information we collect through third party sources

We may obtain your Personal Information from other sources such as third-parties or other subscribers of the Platform.

 

So in conclusion, to research, scrutinise and to understand our subscriber and what content and advertising you may watch or otherwise participate with, in order to improve our service (including our user interface experiences and security features) and optimize content selection i.e. recommend or make it easier for you to find content we think you will enjoy; evaluate your eligibility for certain types of offers, products or services and market such products or services to you; to perform analytics and conduct customer research, including general market research or surveying our customers' needs and opinions on specific issues, generating sales and traffic patterns, and to scrutinise advertising effectiveness, both on an anonymous basis (e.g., by aggregating data) or on an individual basis (if legally permissible), in combination with other information collected from tracking technologies and aggregate it with information collected from other Users using our Platform, to attempt to provide you with the Services and a better experience on the Platform. For example, one of the ways we use this information is to count the number of times an advert or other content is viewed because this might be the metric by which our advertisers pay us. This information is compiled and inspect on an aggregated basis.

 

 

3:  STORAGE AND PROCESSING

Your information(s) collected by KUTTUS  Platform may be stored and processed in India, Bangladesh and/ or United States or any other Country in which KUTTUS or its subsidiaries, affiliates or service providers maintain facilities.

 

4:   DATA SECURITY AND RETENTION

(A)   Data Security

KUTTUS  Platform uses industry practices and procedures to keep your information safe. All information(s) provided by you or information(S) collected automatically are encrypted through a secured service layer (SSL) before it is sent to KUTTUS  Platform. To prevent unauthorised access, maintain data accuracy, and ensure correct use of information, we employ commercially reasonable and practicable security practices and procedures and security methods and technologies.

Information is collected and transferred to and from India and US. Your submission of such information represents your agreement to transfer and storage.

Unfortunately, the transmission of information over the internet is not completely secure. Although we strive to protect the personal data of yours, we cannot guarantee the security of your data while it is being transmitted to KUTTUS  Platform, any transmission is at your own risk. Once we have received your information, we have commercially reasonable procedures and security practices in place to reasonably endeavour to prevent unauthorized access.

Support our IT security efforts by not disclosing any of your personal information or sensitive personal data or information on KUTTUS  Platform. Furthermore, you can help us to protect your personal data by signing off when you finish using login-protected features of services.

KUTTUS  Platform shall not be liable for any data breach if you fail to maintain the security of your device.

 

(B)    Data Retention

We retain your information (including personal information or sensitive personal; data only for as long as we believe it to be reasonably necessary for purposes set out herein for which the information was collected, subject to any legal requirements for the data to be retained for longer period of time. We take reasonable measures to destroy or re-identify personal information in a secure, manner when it is no longer required.

 

6:  YOUR RIGHTS AND CONTROL

(A)    Your Privacy Rights

You have a right to confirm whether we process your personal information and to access and receive a copy of the personal information we process about you. You may also correct or update out-of-date or inaccurate personal information or request that we delete personal information that we hold about you.

Under the CCPA you have the right to access the Personal Information that we have collected about you and from you while you subscribed KUTTUS platform, uses payment methods and other activities and information about our data practices. You also have the right to request us to delete the personal information that we have collected from you.

You can exercise the rights described above when we receive a verified request in accordance with applicable law.

(B) Communication Preferences

If you no longer want to receive certain communications from us via email or text message, please access the “Notification settings” option for the relevant profile within the “Account” section of our website. Alternatively, click the “unsubscribe” link in the email or reply STOP (or as otherwise instructed) to the text message (note: you may receive a confirmation text message in this case). Please note that you cannot unsubscribe from transactional messages from us, such as messages relating to your account transactions.

 

You can choose to receive mobile push notifications from KUTTUS. If you later decide you no longer want to receive these notifications, you can use your mobile device’s settings to turn them off (or via the “Notification settings” described in the preceding section). If you agree to receive those notifications and later decide you no longer want to receive them, you can use your browser’s settings to turn them off.

If you subscribe to an ad supported subscription plan, we can present you with Advertisements, including behavioural advertisements. If you do not want to be presented with behavioural advertisements, you can indicate your choices by changing the “Behavioural Advertising”  you can discontinue. If you opt out, we may still collect and use the information for other purposes.

An option to opt out is not provided in a Kids profile because we do not engage in behavioral advertising on Kids profiles.

 

  • Please note that profiles are available to everyone who uses your KUTTUS account, so that anyone with access to your KUTTUS Platforms can navigate to and use, edit or delete profiles, and information within or associated with the profile. You should explain this to others with access to your account, and if you do not want them to use or change your profile, be sure to let them know. We also have different parental controls available and you can learn more.
  • You may have the option to use certain account login features, such as email-based or text message-based login, or easier login to the KUTTUS app on certain devices. Please note that any device that is logged into your account will remain logged in unless you log out of those devices

  • If you wish to opt out of receiving communications from KUTTUS, Authorised Partners, Third Party Business Partners, you can follow the unsubscribe instructions provided in any marketing emails, or if you wish to opt out from receiving push notifications on your device, you can manage your preferences from your Device or App settings, depending upon the type of device.
  • Please note that you cannot opt out from receiving all communications from KUTTUS, including promotional, operational messages that we may send to you through email, push notifications, SMSs and/or WhatsApp messages.
  • You may have more options depending on your mobile device and operating system. For example- most device operating systems (eg- iOS for Apple phones, Android for Android devices and windows for Microsoft Devices) provide their own instructions on how to limit or prevent the delivery of tailored in-application advertisements. You may review the support materials and/or the privacy settings for the respective operating systems to learn more about these features and how they apply to tailored in-app advertisements.
  • Location Information- We may have access to certain information about your location such as your country or address, which you provide either directly or via device geo-location functionalities of your device. If you access KUTTUS Platforms on your mobile device, we may collect your device’s precise location. To disable the collection of precise location information from your device, you may access your device settings and choose to limit that collection.
  • We may reject opt out requests that are unreasonable, or not required by law, including those that would be extremely impractical, could require disproportionate technical efforts, or could expose us or affiliates, Authorised Partners and/or Third Party Business Partners to operational risks.

KUTTUS platform collect information by automated means when users visit, access, or use our platform that link to this Cookie Policy.

This Cookie Policy describes the information we obtain from Cookies, how KUTTUS Platform use Cookies, and how user can manage them. By using the Services, users acknowledge that they have read and accepted the Cookie Policy. We may periodically update this Cookie Policy without prior notice to reflect changes in our practices.

 KUTTUS reserves the right, at any time and from time to time, to update, revise, supplement and otherwise modify this privacy policy. Any material updates, revisions, supplements, modifications and additional rules, policies, terms, will be posted on the KUTTUS Platforms and will be notified to you by email, push notification, SMS or WhatsApp messages or any other means consistent under applicable law. You may review any material updates, revisions, supplements, modifications and additional rules, policies, terms and reach out to our Data Protection Officer for further information, or to opt out from service(s). your continued use of service after such updates take effect will constitute acknowledgement and as applicable acceptance of those changes.

 

10:  PUBLIC USAGES

You might be requested  to publish, post reviews, comments or communicate with users of our website and/ or android and iOS App(s) information (including personal information) that you choose to post publicly are not guided by this Privacy Policy. This information is deemed to be treated as public information and may be seen or collected by anyone, including third parties, not covered by the Terms of Use or this Privacy Policy. KUTTUS disclaims all liability arising from the distribution of any information you choose to publicly post or share arising from the distribution of any information you choose to publicly post or share through our website and/ or android and Ios App(s).

 

 11: LAW, REGULATIONS AND GRIEVANCE

  1. KUTTUS Platforms has compliant with the Rule 3(1)(b) of the Information Technology Rules which means it is important to keep in mind that the users should be aware of the nature of the content and then make informed choices with the content they put out.
  2. KUTTUS platform has followed the mandate to classify the content they offer into  different age categories Universal, Adult and Parental Guidance,  etc., and then make it available to the viewer.
  3. KUTTUS platforms followed the mandate to classify the content based on its theme, type, tone, impact, and targeted age of the audience it is suitable for. The guidelines prescribed appropriate self-classification of the  shows, instead of directing any censorship. It says that the streaming  platforms will have to rate content in three categories, namely, U- Universal, U/A, and A- Adult.

In our KUTTUS platform a subscriber can open a content marked “A”,  only after putting password lock as created by subscriber himself/herself.

  1. KUTTUS further made sure to classify on the basis of themes of violence, nudity, sex, language, drug or substance abuse, and horror, and the classification details are enumerated In Schedule Part II of Information Technology Rules.
  2. To help users make informed choices, KUTTUS platforms has  rate their content and add a content descriptor to inform the audience  about the theme. The content that is rated ‘A’ shall have an age  verification system and the user won’t be able to access any ‘A’ rated  content without submitting the verification. There are certain rules  that focus on increasing inclusivity like the content should be  accessible to a person with a disability. If the rules are not complied  by the OTT platforms or any publisher, then they shall be liable as  provided under such law which has been contravened (Rule 9 of IT  Rules).

 

  1. The Law shall be governed and construed in accordance with the laws of India. Any proceeding shall be exclusively held before the courts at Kolkata, West Bengal, India.
  2. If permitted under appropriate law, you and KUTTUS may bring claims against the other in its individual capacity only and not as a class member in any purported class or representative proceeding. And if there is disagreement between and you and KUTTUS then the Appropriate Adjudicated body or establishment can not consolidate more than one person’s claims with your claims, and may not provide over any form of a representative or class proceeding.

 

GRIEVANCE

Grievance Redressal Mechanism:

  • As per the Rule 3(2) of the Information Technology Rules KUTTUS  platforms has setup a grievance redressal mechanism  to look after the complaints and make sure the content shown on  these platforms are not in violation of the law in any manner. The  platforms will register their grievance redressal mechanism with the Ministry of Information and Broadcasting (MIB). They have appointed Mr. Ashis Sen as Chief Grievance Officer, who will be  responsible for addressing user complaints and collaborating with  law enforcement agencies. 
  • The KUTTUS platforms has form a grievance redressal mechanism which shall be headed by the Grievance Officer based in Kolkata , West Bengal as per Rule 11 of the IT Rules. You can contact the Grievance Officer at maitriavcombines@gmail.com.
  •  A grievance can be  filed by anybody who thinks the Code has been not complied with  while publishing content. The decision will be taken within 15  days from the day it was received. If it is not communicated as per  the timeline, then it will be escalated to the self-regulating body  under Rule 12 of IT Rules.

 In-App Data Deletion

Users have the ability to delete their personal data directly through the KUTTUS mobile application by following these steps:

  1. Log in to the KUTTUS app

  2. Navigate to the Account section

  3. Tap on the Delete Account / Delete Data option

  4. Confirm your action

Once confirmed, this action will:

  • Permanently delete your account

  • Remove your personal data (name, email, preferences, usage history, etc.)

  • Remove your device identifiers and linked session data

Furnishing Information and Compliance report:

  • As per The Information Technology (Intermediary Guidelines and  Digital Media Ethics Code) Rules, 2021 (hereinafter referred to as  the “IT Rules”) were notified by the Central Government on  25.02.2021the KUTTUS platforms submit all the details of its entity along with the relevant documents to the Ministry of  Information and Broadcasting.

 

Parental Lock:

  • KUTTUS platform as the Rule 3(4) of the Information Technology Rules provide parental locks for content that is classified in the Adult Category. This is to ensure that children  do not access such content under the restricted category.

 

A three-level grievance redressal mechanism has been established under the rules with two levels of self-regulation- Level I being the publisher and Level II being the Self Regulatory Body, and the third level being the Oversight Mechanism under the Ministry of Information & Broadcasting. The existing Rules have introduced a Code of Ethics (Code) to be complied with by publishers of online curated content (OCC)/over-the-top platforms (collectively, OTT Platforms) and publishers of news and current affairs (News Portals), which lays down general principles, metrics for content classification and guidelines for classification of content. It may be relevant to note that the guidelines prescribed in the Code are similar to a notification issued by Ministry of Information and Broadcasting (MIB) dated 6 December 1991 guiding the Board of Film Certification to follow certain principles for sanctioning films for public exhibition. The Code also prescribes age ratings and content descriptors and technology enabled access controls similar to the provisions of the Universal Self-Regulation Code for Online Curated Content Providers, issued by the Internet and Mobile Association of India in 2020
